RE: The tariff classification of an insulated bottle bag from China

Dear Ms. Jewett:

In your letter dated November 19, 2008 you requested a classification ruling. The sample which you submitted is being returned as requested.

A style number was not provided for the sample submitted. It is an insulated bottle bag constructed with an outer surface of man-made textile material. It is designed to provide storage, protection, organization, and portability to a beverage bottle during travel. It is also designed to maintain the temperature of the beverage. The interior has a textile lining with a layer of foam plastics between the outer surface and the interior lining. The holder has an elastic top with a drawstring closure. The bag has a removable, adjustable shoulder strap and a metal carabineer that can hook onto a belt or backpack, etc. It also has a zippered pocket and open pocket to hold a cell phone, money or keys. The holder measures approximately 4.5” in diameter and 11” (H).

The applicable subheading for the insulated bottle holder will be 4202.92.0807, Harmonized Tariff Schedule of the United States (HTSUS), which provides for insulated food and beverage bags, with outer surface of textile materials, other, of man-made fibers. The duty rate will be 7% ad valorem.

HTSUS 4202.92.0807 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
